1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the CrowAI website at https://usecrowai.com and our web application, products, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal authority to enter into these Terms.

3. Accounts and Security

• To use certain features of the Service, you may need to create an account and provide accurate and complete information.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You agree to notify us promptly if you suspect any unauthorized use of your account or any other security breach.

4. Service Description

CrowAI provides AI-powered tools to generate studio-quality headshots and other AI images based on photos and prompts that you provide. The Service may include free and paid plans, credits, photo packs, and other features which we may update or modify at any time.

We reserve the right to change or discontinue any part of the Service at any time, including features, pricing, and availability, with or without notice, subject to any applicable legal requirements.

5. Subscriptions, Credits, and Payments

• Some features of the Service are available only through paid subscriptions or credits.
• By subscribing or purchasing credits, you authorize us or our third-party payment processor to charge your payment method for the applicable fees.
• Unless otherwise stated, subscription plans automatically renew at the end of each billing period (for example, monthly or yearly) at the then-current price until you cancel.
• You can cancel your subscription at any time, but payments are generally non-refundable, except where required by law or explicitly stated otherwise.
• We may offer limited-time promotions, discounts, or free trials. Any such offer is subject to specific terms and may be modified or discontinued at our discretion.

You are responsible for any taxes or fees associated with your purchases and for ensuring that your payment information is accurate and up to date.

6. User Content and AI Outputs

6.1 Your content

You may upload photos, images, prompts, text, and other content ("User Content") to use the Service. You retain ownership of your User Content. By uploading User Content, you grant CrowAI a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, and process your User Content as necessary to provide the Service and to improve and develop our products and models (subject to our Privacy Policy and applicable law).

6.2 AI-generated outputs

Based on your inputs, the Service generates AI-created images and other outputs ("Outputs"). Subject to these Terms and payment of any applicable fees, we grant you a non-exclusive, worldwide license to use, reproduce, modify, and display the Outputs for personal or commercial purposes, to the extent permitted by law and by third-party rights.

Because Outputs are generated using machine learning models, we cannot guarantee that any Output is unique or that it does not resemble other images or content generated by the Service or other systems. You are responsible for ensuring that your use of Outputs complies with all applicable laws and does not infringe third-party rights.

7. Prohibited Uses

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Infringe, misappropriate, or violate the rights of others, including privacy, publicity, and intellectual property rights.
• Generate or distribute content that is unlawful, harmful, hateful, harassing, abusive, defamatory, obscene, sexually explicit, or otherwise objectionable.
• Generate deepfakes or misleading content about real individuals without their consent, especially in ways that could cause harm.
• Exploit or harm minors or generate content involving minors in any sexual or violent context.
• Upload viruses, malware, or other harmful code, or attempt to disrupt or overload the Service.
• Reverse engineer, decompile, or otherwise attempt to derive the source code or underlying models of the Service, except where permitted by law.
• Circumvent or attempt to circumvent usage limits, credits, subscriptions, or security measures.

We reserve the right to suspend or terminate your access to the Service if you violate these Terms or if we reasonably believe your use presents a risk of harm.

8. Intellectual Property

The Service, including its software, user interface, designs, logos, trademarks, and underlying AI models, is owned by CrowAI or its licensors and is protected by intellectual-property laws. Except for the limited rights expressly granted in these Terms, we reserve all rights in and to the Service.

You may not use our trademarks, logos, or branding without our prior written permission.

9. Third-Party Services

The Service may integrate or interact with third-party services, such as authentication providers (e.g., Google), payment processors, hosting, or analytics tools. Your use of such third-party services may be subject to the third party's own terms and privacy policies. We are not responsible for third-party services or their handling of your data.

10. Disclaimers

• The Service and all Outputs are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied.
• We do not warrant that the Service will be uninterrupted, error-free, secure, or that it will meet your expectations or requirements.
• We do not guarantee the accuracy, reliability, or completeness of any Output or other content generated by the Service.

To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the fullest extent permitted by law, in no event will CrowAI, its affiliates, or their respective officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, business opportunities, data, or goodwill, arising out of or in connection with your use of the Service or these Terms.

Our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you have paid to us for the Service in the twelve (12) months prior to the event giving rise to the claim, or (b) an equivalent of such amount as allowed by applicable law.

Some jurisdictions do not allow limitations of liability, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless CrowAI, its affiliates, and their officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service or Outputs, (b) your User Content, or (c) your violation of these Terms or any applicable law.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, pose a risk of harm, or for any other legitimate business reason. Upon termination, your right to use the Service will cease, but sections of these Terms that by their nature should survive (such as ownership, disclaimers, limitations of liability, and indemnification) will remain in effect.

14. Governing Law and Disputes
